CD11.R1    The Directing Council,

Having examined the annual report of the Executive Committee, presented by Dr. Miguel E. Bustamante, representative of Mexico and Chairman of the 37th Meeting of the Committee; and

Considering the terms of Article 8-C of the Constitution of the Pan American Health Organization,

RESOLVES:

To approve the annual report of the Chairman of the Executive Committee and to congratulate the Chairman, Dr. Miguel E. Bustamante, and all members of the Committee on the work accomplished

Having examined the report of the Director on the collection of quota contributions, contained in Document CD11/19 and Addendum I,

CD11.R3    The Directing Council,

Having studied the amendments proposed by the Director to Article IV, Regulations 4.3 and 4.4, of the Financial Regulations of the Pan American Sanitary Bureau;

Taking into account the fact that the proposed changes reduce administrative work and budgetary problems and provide the necessary flexibility for PAHO fellowships;

Considering that these changes do not affect the basic provisions or the pattern established by the Directing Council when the Financial Regulations were established in 1951; and

Concurring in the recommendation set forth in Resolution VI of the 37th Meeting of the Executive Committee,

RESOLVES:

To adopt the following amendments to the Financial Regulations of the Pan American Sanitary Bureau, effective beginning with the fiscal year 1959:

Article IV, Regulations 4.3 and 4.4, revised to read:

4.3  Appropriations shall remain available for twelve months following the end of the financial year to which they relate, to the extent that they are required to discharge the outstanding legal obligations as of 31 December of that year, except for amounts obligated for fellowship awards, which shall remain available until the fellowship is completed. Any remaining balance of appropriations will revert to the Working Capital Fund.

4.4  At the end of the twelve-month period provided in Regulation 4.3, the remaining balance of any appropriations will revert to the Working Capital Fund. Except for obligations in respect to fellowships as provided in Regulation 4.3, any unliquidated obligations of the prior twelve months shall at that time be canceled; where the obligation remains a valid charge, it shall be transferred as an obligation against current appropriations.

CD11.R4    The Directing Council,

Having studied Document CE37/6 relating to amendments to the Staff Rules and Staff Regulations of the Pan American Sanitary Bureau;

Considering the recommendation made by the Executive Committee at its 37th Meeting, in Resolution VII;

Acting pursuant to Articles 12.1 and 12.2 of the Staff Regulations.

RESOLVES:

1.      To approve the amendments to Articles 3.2, 3.3, and 6.2 of the Staff Regulations of the Pan American Sanitary Bureau as presented in Document CE37/6, Annex I.

2.       To take note of the amendments by the Executive Committee at its 37th Meeting, which appear in Document CE37/6 Annex II.

CD11.R5    The Directing Council,

Having examined the report presented by the Director on the use of the Emergency Revolving Fund (Document CD11/18); and

Considering that, if the Fund is to serve its important purpose of collaboration with the Governments, it is essential that it be maintained at the established level,

RESOLVES:

1.      To take note of the report on the use of the Emergency Revolving Fund presented by the Director of the Pan American Sanitary Bureau.

2.      To invite the Governments, when they request assistance from the Fund, to reimburse as soon as possible the amounts advanced [therefrom].

CD11.R6    The Directing Council,

Having studied the Financial Report of the Director and the Report of the External Auditor for 1958 (Official Document Nº 29); and

Noting the action of the Executive Committee of the Executive Committee at its 37th Meeting regarding the aforesaid reports (Resolution II),

RESOLVES:

To approve the Financial Report of the Director and the Report of the External Auditor for the fiscal year 1958.

CD11.R7    The Directing Council,

Noting the serious financial condition of the Organization as reflected in the Financial Report of the Director for 1958 and the special reports on the status of the Working Capital Fund prepared by the Director;

Taking into account the comments of the External Auditor in his report for 1958 with respect to the seriousness of the financial position of the Organization;

Considering the action taken in Resolution X of the 37th Meeting of the Executive Committee; and

Believing it essential that suitable steps be taken to ensure adequate financing of the Organization's activities in the future,

RESOLVES:

1.      To call to the attention of the Member Governments the necessity of paying their annual quota contributions as early each year as possible.

2.      To request the Member Governments whose quota contributions are in arrears to pay them at the earliest possible date.

3.      To approve the assignment of a portion of the budget for gradually increasing the Working Capital Fund until the authorized level has been reached, and for maintaining the Fund at that level.

CD11.R8    The Directing Council,

Having examined the Annual Report of the Director of the Pan American Sanitary Bureau, Regional Office of the World Health Organization for the Americas for 1958 (Official Document Nº 30),

RESOLVES:

To approve the Annual Report of the Director, congratulating him on the effective work accomplished and on the form of presentation of the report, and extending the congratulations to the staff of the Bureau.

CD11.R9    The Directing Council,

Considering the serious financial situation of the Pan American Health Organization, as reflected in the Financial Report of the Director and Report of the External Auditor for 1958 and in the reports on the status of quota collections and on the Working Capital Fund presented by the Director; and

Bearing in mind the comments made by various representatives with regard to the most effective means for having the Governments make regular payment of their quota contributions,

RESOLVES:

1.      To request the Director to supply further information to the Governments on the financial situation of the Organization through periodic communications sent simultaneously to the ministries of public health and of foreign affairs.

2.      To point out to the Member Governments the advisability that in the ministries of public health there be an office responsible for relations between the national public health organizations and the international health agencies.

3.      To suggest to the Member Governments the adoption of administrative and legislative measures that will make it possible to adjust the dates of quota payments to the fiscal year of the Organization.

4.      To request the Director to approach the Member Governments for the purpose of having them, at the level of their national technical assistance boards, expand their public health programs, and to approach also the Organization of American States with a view to obtaining larger contributions from the Program of Technical Cooperation for public health activities.

5.      To request the Director to study new measures that might be adopted with respect to the sale of publications and the furnishing of other services for the purpose of increasing the income of the Organization as much as possible.

CD11.R10    The Directing Council,

RESOLVES:

1.      To appropriate for the financial year 1960 an amount of $4,100,000, as follows:

2.       [To approve that] amounts not exceeding the appropriation noted under paragraph 1 be [made] available for the payment of obligations, in accordance with the Financial Regulations of the Bureau, incurred during the period 1 January to 31 December 1960, inclusive.

3.       [To approve that] the appropriations as noted above be financed by contributions from the Member Governments according to Article 60 of the Pan American Sanitary Code; contributions on behalf of France, Kingdom of the Netherlands, and the United Kingdom according to Resolutions XV and XL of the V Meeting of the Directing Council, and miscellaneous income accruing to the Pan American Sanitary Bureau.

4.       [To authorize] the Director to transfer credits between parts of the budget, provided that such transfers of credits between parts do not exceed 10 per cent of the part from which the credit is transferred. Transfers of credits between parts of the budget in excess of 10 per cent may be made with the concurrence of the Executive Committee. All transfers of budget credits shall be reported to the Directing Council.

CD11.R11    The Directing Council,

Having examined the report on the 38th Meeting of the Executive Committee presented by Dr. Miguel E. Bustamante, representative of Mexico and Chairman of that Meeting; and

Considering the terms of Article 8-C of the Constitution of the Pan American Health Organization,

RESOLVES:

To approve the report on the 38th Meeting of the Executive Committee and to congratulate the Chairman, Dr. Miguel E. Bustamante, and all members of the Committee on the work accomplished.

CD11.R12    The Directing Council,

Having studied the problems raised by the present text of the Financial Regulations;

Having reviewed the proposals of the Director to overcome these problems; and

Considering the recommendation set forth in Resolution III of the 38th Meeting of the Executive Committee,

RESOLVES:

To adopt the following changes in the text of the Financial Regulations:

a)    Change the title from "Financial Regulations of the Pan American Sanitary Bureau" to "Financial Regulations of the Pan American Health Organization."

b)Revise Article I to read as follows:

1.1    These regulations shall govern the financial administration of the Pan American Health Organization.

1.2    The Director of the Pan American Sanitary Bureau shall receive, deposit, and administer all funds and assets of the Pan American Health Organization in accordance with these Financial Regulations.

3.      Replace the word "Bureau" by "Organization" in Regulations 6.1, 7.2, 8.1, 10.1, 10.3, 10.5, 11.1, 11.2, 12.1, 12.2, and 12.8.

CD11.R13    The Directing Council,

Bearing in mind the reports presented at this meeting by Guatemala and Honduras on the status of the eradication of Aedes aegypti, according to which those countries are declared to be free of Aedes aegypti, after satisfactorily meeting the standards on which the criteria established by the Pan American Sanitary Bureau for that purpose are based,

RESOLVES:

To accept the reports presented, in which it is declared that Guatemala and Honduras are free of Aedes aegypti, and to call upon the other countries and territories that are still infested to intensify their anti-aegypti activities in accordance with the terms of the resolution approved at the XI Pan American Sanitary Conference in Rio de Janeiro, and to recommend that those countries in which the vector has already been eradicated maintain a strict vigilance in order to prevent reinfestations.

CD11.R14    The Directing Council,

Having considered Document CD11/20 1 on the United Nations Special Fund and the Fund's potential support of health projects; and

Having noted that Resolution WHA12.51 authorizes the Director-General of the World Health Organization to cooperate with the Special Fund and to enter into working arrangements for the provision of services and the execution of health projects,

RESOLVES:

1.      To invite the Member Governments, in reviewing their health programs, to take into account the Special Fund as a potential source of international assistance and to present appropriate projects through the designated channels.

2.      To request the Director to cooperate with the Member Governments in planning projects appropriate for financing under the United Nations Special Fund, especially surveys necessary for the development of water supply programs.

3.      To request the Director to cooperate, through appropriate channels, with the Special Fund for the provision of services and the execution of health projects.

CD11.R15    The Directing Council,

Elected Colombia and El Salvador to the Executive Committee upon termination of the periods of office of Guatemala and Peru, and thanked the Governments of these countries for the valuable services rendered to the Organization by their representatives on the Committee.

CD11.R16    The Directing Council,

Having considered Resolution WHA12.48 of the Twelfth World Health Assembly on the subject of environmental sanitation;

Recognizing that the considerations so well stated in the aforementioned resolution apply with special force in the Region of the Americas, for example:

a)     That safe and adequate supplies of water to inhabitants of communities constitute an important measure for the protection and improvement of health and are indispensable for economic and social development;

b)   That the provision of community water supplies depends on the closely coordinated efforts of engineering, financial, and administrative personnel;

c)    That a primary deterrent to the early construction of community water supplies on an adequate scale is the difficulty of financing, and that the ministries of health or other competent governmental agencies are generally not in a position to independently develop schemes for the financing of such works;

Recognizing that some Governments may wish to make funds available to the Pan American Health Organization to provide advisory services to Governments in community water supply programs, in addition to the work financed from the regular budget; and

Recognizing the special need for the Pan American Health Organization, regional organ of the World Health Organization, to take urgent action to promote water development programs and to coordinate international efforts in this program, including the stimulation and utilization of international financial resources,

RESOLVES:

1.      To endorse Resolution WHA12.48 of the World Health Assembly.

2.      To emphasize the recommendations to the Member Governments contained in the aforementioned resolution, which read:

a)    That priority be given in national programs to the provision of safe and adequate water supplies for communities;

b)    That, wherever necessary, national or provincial water boards be established and given authority to deal with the various legal, administrative, and fiscal responsibilities involved in such programs;

c)    That all available national and local resources of money, materials, and services contributory to such a program be mobilized;

d)    That within each country requiring such a facility a revolving fund be established to provide loans for water supply development to local agencies of governments; and

e)    That full advantage be taken of existing international loan funds.

3.      To request the Director:

a)    To cooperate with the Member Governments in projects to provide adequate and safe supplies of water to the inhabitants of their communities;

b)    To study all possible ways and means of rendering assistance; and

c)    To cooperate with all agencies, national and international, that will participate in the development of water supply programs, with special emphasis on the stimulation of financial resources.

4.      To authorize the Director to secure financial participation and accept any contributions from public or private organizations, national or international, for the purpose of providing assistance to the Governments in planning, preparing for, and obtaining other technical assistance in the development of community water supply.

5.      To request the Director to establish, under Article XI, paragraph 11.3, of the Financial Regulations, a special account for the purposes set forth in paragraph 4 of this resolution.

6.      To provide that the funds in the special account shall be available for incurring obligations for the purposes set out in paragraph 4 of this resolution and that, notwithstanding Article IV, paragraph 4.3, of the Financial Regulations, the unexpended balance of the account shall be carried forward from one financial year to the next.

7.      To request the Director to present the operations financed, or planned to be financed, from the special account separately in the annual program and budget estimates and to present the operations of the account separately in the annual Financial Report.

8.      To request the Director to make adequate provision in future program and budget estimates to allow the Organization to maintain leadership in a coordinated regional program of community water supply and to provide the necessary technical and advisory services to the Governments.

9.      To invite all multilateral and bilateral agencies having an interest in this field to cooperate with the Pan American Health Organization in carrying out a regional water supply program.

10.To request that international and national financial institutions accord high priority to requests for loans to carry out water supply programs, since water is essential in the life of man and fundamental to the economic development of nations.

CD11.R17    The Directing Council,

Having taken note of Resolution WHA12.22 of the Twelfth World Health Assembly on the participation of WHO in the Expanded Program of Technical Assistance;

Considering that the diminished level of funds for project activities under the aforesaid Expanded Program applies to the situation in the Americas, in which some of the Governments, in submitting their consolidated program requests to the Technical Assistance Board, have increased other programs, with a corresponding reduction in the amounts available for health activities; and

Considering that reductions in the portion for health activities not only diminish the funds for the program year but also have the effect of reducing the regional planning ceiling for the subsequent year,

RESOLVES:

1.      To endorse Resolution WHA12.22 on WHO participation in the Expanded Program of Technical Assistance.

2.      To recommend to the Member Governments, in relation to future requests to the Technical Assistance Board for projects under the Expanded Program of Technical Assistance:

a)    That full consideration be given to health activities as a basic part of economic and social development, which merits an important share of the program; and

b)    That action should be taken, whenever reductions in the health portion of the aforesaid Expanded Program have occurred, to redress the balance by including a larger portion for health activities in future annual requests to the Technical Assistance Board.

3.      To endorse the Regional projects that are to be financed in 1960 with funds from the aforesaid Expanded Program, as submitted to the Technical Assistance Board.

CD11.R18    The Directing Council,

Having examined Document CD11/13, in which the Director brought to the attention of the Regional Committee for the Americas Resolutions WHA12.15, WHA12.49, WHA12.42, and EB23.R51,

RESOLVES:

To take note of Resolutions WHA12.15 (Malaria Eradication Special Account), WHA12.49 (Malaria Eradication Program), WHA12.42 (Convention on the Privileges and Immunities of the Specialized Agencies: Status of accessions to the Convention and to Annex VII thereof), and EB23.R51 (Method of Appointing Regional Directors).

CD11.R19    The Directing Council,

Having considered the report of the Director on the matter of the existing accident and sickness insurance and the proposal for a more comprehensive health insurance plan for Pan American Sanitary Bureau staff members and their families;

Noting the action being taken in this matter by the World Health Organization; and

Having considered the financial implications of adopting the health insurance program,

RESOLVES:

1.      To authorize the Director to establish for Pan American Sanitary Bureau staff members the same health insurance benefits available to WHO staff members, if such insurance is desired by a majority of the staff.

2.      To approve the expenditure of PAHO funds in an amount adequate to cover the portion that the Organization will have to contribute toward the cost of the new insurance plan.

CD11.R20    The Directing Council,

Having noted and studied the proposals made by various countries concerning an International Health and Medical Research Year, as well as the action taken thus far by the World Health Assembly, the WHO Executive Board, and the Director-General; 1 and

Having noted the interest of other organizations in cooperating in such an activity,

RESOLVES:

1.      To express its agreement with the concept of an International Health and Medical Research Year.

2.      To urge the Member Governments to submit their comments and specific suggestions to the Director-General of the World Health Organization, in accordance with his request.

3.      To urge the Member Governments to start preparation of plans so as to assure full and effective national and local participation if the proposal is approved by the World Health Assembly.

CD11.R21    The Directing Council,

Considering that for a number of years there has been available an effective vaccine against smallpox, whose systematic and properly organized application is sufficient to ensure the complete protection of the population, and that, despite this fact, smallpox continues to be a serious public health problem in the Hemisphere;

Recognizing it to be essential that the efforts of all the countries of the Americas be coordinated in order to eradicate this disease; and

Taking into account the resolutions on this subject adopted by the Governing Bodies of the Pan American Health Organization and the World Health Organization,

RESOLVES:

1.      To express its satisfaction at the fact that in some countries of the Americas smallpox has already disappeared, and that other countries of the Continent are conducting nation-wide and intensive campaigns against this disease.

2.      To recommend that the Member Governments give special attention to the continuation of programs directed toward the maintenance of high levels of immunity, in order that the gains achieved so far may be made permanent.

3.      To call upon the Governments of countries where smallpox still exists and where nation-wide smallpox vaccination programs have not yet been initiated to undertake such programs as soon as possible, as a measure to protect public health and as a contribution to the continent-wide program to eradicate the disease.

4.      To recommend that the Member Governments study ways and means of producing and storing adequate supplies of smallpox vaccine for use in national programs for vaccination and for control of possible outbreaks, and [that they] furnish, [at the] request of the Pan American Sanitary Bureau, the information needed to keep an up-to-date record of the supplies of vaccine available for use in the control of any new smallpox outbreak or in any emergency situation that might arise in any country.

CD11.R22    The Directing Council,

Having examined the Director's report on buildings and installations for Headquarters and Zone Offices (Document CD11/24); 1 and

Having noted the action taken by the Government of the United States of America regarding land for the Headquarters site of the Pan American Health Organization,

RESOLVES:

1.      To express its appreciation to the Government of the United States of America for the measures taken in connection with the donation of land to the Pan American Health Organization for the construction of a Headquarters building.

2.      To instruct the Director to continue to inform the Executive Committee on the developments in this matter.

CD11.R23    The Directing Council,

Having considered the report of the Director on the matter of recruitment of professional personnel and the secondment to the Pan American Sanitary Bureau of qualified national public health personnel;

Noting that the present Staff Rules and Regulations make possible medium-term appointment and the granting of a terminal emolument under the service benefit; and

Considering the action taken on this matter by the World Health Organization,

RESOLVES:

1.      To request the Director to report to the Executive Committee on the results of the action of the World Health Organization on this matter and on his proposals for action by the Pan American Health Organization.

2.      To call upon the Member Governments to draft legislation, in keeping with the minimum conditions established by the WHO Executive Board, to provide for the secondment of officials to PAHO.

CD11.R24    The Directing Council,

Considering that the type of agency known in Venezuela as the Coordinating Committee for a Nation-Wide Study of Mycoses has proved to be extremely useful in introducing the valuable collaboration of private initiative into the official institutions in charge of public health programs; and

Bearing in mind that the most recommended method for ascertaining the magnitude of the mycoses problem in the Americas is through epidemiological surveys that are carefully planned and evaluated,

RESOLVES:

1.      To recommend to the Member Countries of the Pan American Health Organization that they promote the creation of coordinating committees of nation-wide scope for the study of mycoses.

2.      To recommend to Member Countries of the Pan American Health Organization the undertaking of epidemiological surveys as a means of ascertaining the magnitude of the problem of mycoses in the Americas.

CD11.R25    The Directing Council,

Having examined Official Document 28 submitted by the Director of the Pan American Sanitary Bureau and containing the Proposed Program and Budget of the World Health Organization for the Region of the Americas for 1961; and

Bearing in mind that the aforesaid Proposed Program and Budget is submitted to the Directing Council, as Regional Committee of the World Health Organization, for review and transmittal to the Director-General of the Organization so that he may take it into consideration in the preparation of the proposed budget of WHO for 1961,

RESOLVES:

To approve the transmittal of the Proposed Program and Budget of the World Health Organization for the Region of the Americas for 1961, and to request the Regional Director to transmit it to the Director-General of the Organization so that he may take it into consideration when preparing the WHO budget for 1961.

CD11.R26    The Directing Council,

Having examined Official Document 28 submitted by the Director of the Pan American Sanitary Bureau and containing a provisional draft to be considered as the preliminary basis for the Proposed Program and Budget of the Pan American Health Organization for 1961 to be submitted to the 40th Meeting of the Executive Committee and to the XII Meeting of the Directing Council;

Recognizing that the provisional draft of the Proposed Program and Budget comprises well-conceived and much-needed health projects;

Considering, however, that in view of the practical needs of the countries a greater emphasis on environmental sanitation is important; and

Having heard the opinions of several delegations that the difficulty their countries are having at the present time in meeting their quota assessments regretfully compels them to request no further increase in the program for 1961,

RESOLVES:

1.      To take note of the provisional draft of the Proposed Program and Budget of the Pan American Health Organization for 1961.

2.      To instruct the Director, in preparing the Proposed Program and Budget for 1961, and in his consultations with the Governments on this matter, to give due consideration to the recommendations expressed by several delegations with regard to content and to budget level.

CD11.R27    The Directing Council,

Bearing in mind Resolution IX of the XIII Pan American Sanitary Conference,

RESOLVES:

1.      To express its appreciation to the Government of the Republic of Cuba, and to accept its invitation to hold the XII Meeting of the Directing Council, XII Meeting of the Regional Committee of the World Health Organization for the Americas, and the meetings of its Executive Committee in the City of Havana.

2.      To request the Director to prepare a report on the obligations of the Government of Cuba and of the Pan American Sanitary Bureau with respect to the financial arrangements as well as those relating to premises, equipment, services, and secretariat personnel, and present it to the 40th Meeting of the Executive Committee for consideration.

CD11.R28    The Directing Council,

Having examined Document CD11/8, together with its annex containing the "Declaration of the XV Pan American Sanitary Conference, San Juan, Puerto Rico" (Document CE37/4, Rev. 1); and

Considering that the XV Pan American Sanitary Conference transmitted the first draft of the aforesaid document, which it had approved in principle, to the Executive Committee, and that the latter, at its 37th Meeting, after [studying it carefully and introducing] in it changes that in no way affected the substance of the text, [agreed in] Resolution XIII to transmit it to the Directing Council,

RESOLVES:
To take note of the "Declaration of the XV Pan American Sanitary Conference, San Juan, Puerto Rico, 1958."

CD11.R29    The Directing Council,

Having studied the progress report of the Subcommittee on Basic Documents of the Pan American Health Organization contained in Document CE37/13; and

Having noted Resolution XII of the 37th Meeting of the Executive Committee,

RESOLVES:

1.      To take note of the report of the Subcommittee on Basic Documents of the Pan American Health Organization (Document CE37/13), and to express its appreciation to the members of the Subcommittee for the work they are accomplishing.

2.      To authorize the Executive Committee to have the revised texts of the Basic Documents prepared in French and Portuguese as well as in English and Spanish.

3.      To request of the Executive Committee that a further report be presented to the next meeting of the Directing Council.

CD11.R30    The Directing Council,

Bearing in mind that at both the XV Pan American Sanitary Conference and the X Meeting of the Directing Council the Member Governments of the Pan American Health Organization expressed their deep and constant concern over the problems arising from the misleading advertising of medicinal products directed to the general public;

Taking into account the fact that at present there are no available means of control that are easily applied and are acceptable to all the Governments; and

Considering that, in conformity with Resolution XXV of the X Meeting of the Directing Council, the Pan American Sanitary Bureau already has under study the problem of drug registration in the Member Countries,

RESOLVES:

1.       To instruct the Director to study the present situation of the control of advertising directed to the general public and to inform the next meeting of the Council on the progress and studies made with respect to the following points:

a)    Nature of the control of advertising in the different countries;

b)    Measures of self-regulation within the industry; and

c)    Practical problems arising from the application of various legislations or activities for the control of advertising.

2.      To recommend that the Governments of the Member Countries adopt measures to prohibit false or misleading advertising of medicinal products.

RESOLVES:

To select the topic "Technical, Administrative, Legal, and Financial Aspects of Garbage and Refuse Disposal" for the Technical Discussions that will take place during the XII Meeting of the Directing Council.

Bearing in mind that the program of continent-wide malaria eradication is already well advanced, and that various countries report considerable areas already free of the disease; and

Considering the need to employ the most careful epidemiological techniques in order to ensure that malaria has been completely eliminated in a given territory,

RESOLVES:

To request that the Director study the possibility of establishing in the Pan American Sanitary Bureau a Register of Areas Where Malaria is Eradicated, as well as the conditions that Member Governments should fulfill to request that a given area be included in the aforesaid Register, and that he report the results of his study to the 40th Meeting of the Executive Committee.

RESOLVES:

1.      To take note of the report.

2.      To express its satisfaction with the manner in which the discussions were conducted.

3.      To express appreciation to the Moderator, the Rapporteur, the consultants, and the members of the panel for their valuable contribution to the success of the discussions.
